Cancellation Policies

  • Unexpected emergencies and conflicts will arise from time to time. In order to avoid cancellation fees, VADR works with the parties to reschedule mediations.

  • In the event a party wishes to cancel, adjourn, or postpone the mediation, the party must notify VADR in writing of the cancellation. If the mediation is cancelled or postponed more than 30 days prior to the scheduled date for the mediation, there will be no cancellation fee

  • If the mediation is cancelled within 30 days of the scheduled date for the mediation (but more than two weeks from the scheduled date of the mediation), the cancellation fee will be half of the mediator’s fee for the mediation.

  • If the mediation is cancelled within two weeks of the scheduled date of the mediation, the cancellation fee will be the mediator’s full fee for the mediation.

  • Cancellation fees are due and payable immediately upon the cancellation, adjournment, or postponement of the mediation.

  • In the event VADR is able to book other paying work on the date that the mediation was scheduled to occur, VADR will refund half of the cancellation fee to the parties.

  • If the mediation is cancelled and a cancellation fee applies, each party is responsible for half of the total cancellation fee.

*For mediations requiring travel outside of Alabama, travel time is billed at half the hourly rate ($475 per hour) plus reasonable expenses for lodging, food, and airfare. The parties to the case will share all mediation fees and expenses equally, unless otherwise agreed.
